The tax return mistakes Spain’s tax authority catches almost effortlessly

No audit needed to catch them: they surface on their own when your return is cross-checked against what third parties already report. These are the ones that come up most often.

Most income tax return mistakes aren’t caught because an inspector reviews it line by line. They’re caught because the tax authority automatically cross-checks your return against what third parties already reported — your bank, your clients, your employer, social security — and any mismatch surfaces on its own. These are the cross-checks that generate the most errors, not the usual generic list.

Withholdings that don’t match what the payer declared

If you’re self-employed and invoice with withholding tax (the general 15%, or the reduced 7% during your first two years of activity), that withholding has to match what your client reported having withheld from you in their own filing (Modelo 190). If you declare a different withholding than what the payer reported — due to a calculation error, applying the reduced rate after it no longer applied, or vice versa — the tax authority catches it in the automatic cross-check, not in a manual review.

Platform and marketplace income that’s already self-reported

Vacation rental platforms, sales marketplaces, and gig-economy platforms are required to report their users’ income to the tax authority. If that income doesn’t appear on your return, it isn’t an omission that slips through — it’s exactly the kind of mismatch the system is designed to flag automatically.

Regional deductions applied wrong, or not applied at all

The mistake here cuts both ways. On one hand, claiming a regional deduction without meeting every requirement (income limits, lease age, property type) triggers an adjustment once caught. On the other — and this is far more common than it seems — not claiming deductions you’re actually entitled to, because they change every year and by region, and no tax software proactively suggests all of them unless you go looking.

Not declaring the sale of an asset because «you didn’t make money»

Selling a home, shares, or a vehicle for less than it cost you still has to be declared — as a capital loss, which can also offset gains from other tax years within legal limits. Many people assume that if there’s no gain, there’s nothing to declare, and end up wasting a loss they could have used to reduce their tax bill in later years.

Foreign income, even if it’s already been taxed there

If you’re a Spanish tax resident, you declare your worldwide income — including income already taxed in another country. What avoids double taxation isn’t leaving it off your return, it’s correctly applying the international double-taxation deduction or the relevant bilateral treaty. Simply omitting that income, instead of declaring it and applying the deduction, is the mistake that most often leads to a correction for anyone with income or assets outside Spain.
